NY Appellate Court affirms $20 million for traumatic brain injury victim Mark Perez
NEW YORK, NEW YORK. July 20, 2021 — Morelli Law Firm is pleased to announce that Mark Perez has been awarded $20 million for his pain and suffering after he sustained a severe traumatic brain injury in a work-related fall. The decision was announced by the New York Appeals Court and is the largest pain-and-suffering award in state history, pushing the court into a more modern era. The court also affirmed $13.5 million for medical care and lost wages.
The case, Perez v. Live Nation Worldwide, Inc., was initially filed in July 2013 by Benedict Morelli and team.
In June 2013, the plaintiff was working construction at a Jones Beach concert theater, licensed by Live Nation, when he fell 10 feet onto the ground after a forklift hit the booth he was working on. The fall resulted in a severe traumatic brain injury, among other permanent injuries, including partial paralysis, chronic pain and headaches, cognitive disabilities, post-traumatic epilepsy, encephalomalacia (brain tissue damage), skull fractures, depression, anxiety, and post-traumatic stress disorder.
A jury originally awarded Perez $102 million for his damages before it went to the appellate court.
