Despite winning its first two pelvic mesh bellwether trials in Massachusetts,Boston Scientific has been slapped by a Texas state jury with the largest pelvic mesh verdict in history – a staggering $73.4 million.
The verdict for its third bellwether case, which was handed down after a two-week trial in Dallas, found the company’s Obtryx-brand transvaginal sling to be defectively designed and the cause of severe injuries to plaintiff Martha Salazar.
The result goes against the previous two bellwether trial findings that Boston Scientific was clear of all liability, instead echoing Friday’s $3.27 million verdict against Johnson & Johnson subsidiary Ethicon Inc., where a West Virginia federal court jury found the company’s transvaginal sling was also defectively designed and that users were not warned of potential risks.
The bellwether trials for Boston Scientific and Ethicon Inc. represent many of the roughly 40,000 pelvic mesh law suits that are have been consolidated in multidistrict litigation in state and federal courts across the country.
