Firm Holds Doctor, Hospital Responsible for Premature Birth
The doctor and hospital responsible for the premature birth of a baby girl were found negligent and liable to pay $2 million in compensation. The doctor responsible incorrectly estimated the age of the fetus, negligently inducing labor which resulted in Plaintiff’s premature birth. Defendant also failed to perform the procedure in a clinical setting, failed to obtain an appropriate medical history, failed to properly interpret the ultrasounds, failed to properly conduct a medical exam and failed to appropriately asses Plaintiff’s wellbeing. As a result, Plaintiff was born 12 weeks early, and suffered respiratory distress requiring mechanical ventilation, apnea, anemia, malnutrition, hemorrhage, and cognitive, speech, neurological and motor delay.
When a jury rules like this in a sexual harrasment case, they know that it was international, and they also know that the reason this manager was able to get away with this was that the company had to be looking the other way."
