Martha M. McBrayer
Martha M. McBrayer is a Partner and chairs the Employment Discrimination / Sexual Harassment and Mass Tort Departments at Morelli Ratner. Her practice also includes sexual assault, defamation, negligence cases, civil rights, and appeals. Ms. McBrayer graduated cum laude from Yale University in 1985 with a B.A. in History. She received her J.D. from Georgetown University Law School in 1988. Following law school, Ms. McBrayer clerked for The Honorable John T. Copenhaver, Jr. of the United States District Court for the Southern District of West Virginia. She subsequently worked as a litigation associate at Lane Powell Spears Lubersky, the largest defense firm in the Pacific Northwest, where she represented corporations in negligence, construction contract and employment discrimination cases, and prosecuted criminal trials for the Multnomah County District Attorney’s Office. Ms. McBrayer has represented plaintiffs since 1993 when she began working as an associate in San Francisco for Melvin M. Belli, a founder of the American Trial Lawyers Association then known as “The King of Torts.” Ms. McBrayer’s practice for Belli included sexual harassment and assault cases (including molestation cases against a church organization), catastrophic personal injury cases (including airplane accidents), medical malpractice, and appellate work. Ms McBrayer has worked for Morelli Ratner in New York since 1999. As chair of the firm’s Employment Discrimination/Sexual Harassment Department, Ms. McBrayer has successfully represented individuals throughout the country in litigation against some of the world’s largest corporations, including investment banks, Fortune 500 corporations and national broadcasting networks, and against various television personalities, performing artists, political/religious leaders, sports figures, and other celebrities. Her complaint against one such personality was dubbed by legal analysts on “The Today Show” as “the perfect complaint” and was subsequently used by a Washington composer as a libretto for an opera. Ms. McBrayer has won tens of millions of dollars for victims of rape, assault and sexual harassment, and tens of millions of dollars for victims of age, gender and race discrimination. She has also served as co-counsel in class action discrimination actions filed in federal courts in Tennessee and Indiana. Ms. McBrayer has lectured on the successful instigation and prosecution of sexual harassment and employment discrimination cases. As chair of the firm’s Mass Tort Department, Ms. McBrayer has organized successful litigations against some of the largest pharmaceutical companies in the world, winning hundreds of millions of dollars for plaintiffs, and millions of dollars in appeals. Ms. McBrayer’s appellate practice has included appeals in the Second, Third, Fifth and Ninth Circuits, as well as New York’s First and Second Departments. She is admitted to federal courts in the Northern District of California, the Southern District of New York and the Eastern District of New York. Ms. McBrayer has been admitted to the New York, California, Oregon and Maryland Bars, and is a member of the New York State Trial Lawyers Association.
