Birth Injuries

Many parents are unaware that their child’s “birth defect” is truly the result of an injury sustained from medical negligence or carelessness. Cerebral palsy is one condition which may be caused by a number of errors or incidents during birth.

Birth injuries may also occur when the wrong medication or an excessively high dosage is administered to the mother. Birth inducers can have negative impact on infants when given at the wrong time or in the wrong dosage, and other types of defects may be caused when certain prescription drugs are administered to the mother during pregnancy. Although these are not strictly considered birth injuries, they are caused by medical malpractice and should be pursued as a birth injury would be dealt with.

Types of Birth Injuries

Birth injuries include:

  • Erb’s palsy (brachial palsy)
  • Facial paralysis caused by forceps
  • Bone fractures
  • Brain injury from oxygen deprivation

While these may sometimes be referred to as “common birth injuries,” the truth is that no child should sustain an unnatural injury during birth. The use of forceps and vacuum suction during childbirth are some of the greatest contributors to birth injuries, but ultimately the individuals handling the birth are responsible for the health and safety of both mother and child.
